Terms & Conditions

1. General Provisions

These Terms & Conditions set out the rules for using the online store available at Louveedc.com and for purchasing products offered through the website.

The online store is operated by:

ALAMO COMPANY SPÓŁKA Z OGRANICZONĄ ODPOWIEDZIALNOŚCIĄ
(a Polish limited liability company)
Czarnożyły 148
98-310 Czarnożyły
Poland

NIP: 8322104399
REGON: 545399023
Email: louve.edc@gmail.com

The Store sells goods exclusively through the Internet.

These Terms & Conditions define the rights and obligations of the Seller and the Customer, including the rules for placing orders, payments, delivery, complaints, returns and withdrawal from distance contracts.

Before placing an order, the Customer should read these Terms & Conditions and accept them where required during the ordering process.

Nothing in these Terms & Conditions is intended to limit or exclude any mandatory rights granted to consumers under applicable law.

2. Technical Requirements

To use the Store, the Customer needs:

  • a device with access to the Internet;
  • a current web browser capable of displaying modern websites correctly;
  • an active email address where required for placing an order, creating an account or contacting the Store;
  • JavaScript and cookies enabled where they are necessary for the proper operation of the shopping cart, checkout, customer account or other Store functions.

The Customer is responsible for ensuring that the device and software used to access the Store meet the above technical requirements.

The Store may temporarily be unavailable due to maintenance, updates, technical work or circumstances beyond the Seller’s reasonable control. Where possible, such interruptions will be kept to the minimum necessary.

3. Customer Account

Creating a customer account in the Store is voluntary and free of charge.

A customer account allows the Customer to access account information, manage personal details and addresses, and view information relating to orders placed through the Store.

The Customer is responsible for providing accurate and up-to-date information when creating and using the account and for keeping account login credentials confidential.

The Customer may request deletion of the account at any time by contacting the Store at louve.edc@gmail.com.

If an order is still being processed at the time the account deletion request is received, the Store may retain the information necessary to complete that order and to comply with legal, accounting, tax or claims-related obligations.

Deletion of a customer account does not affect the Store’s right or obligation to retain personal data where such retention is required by applicable law. For more information, please see the Privacy Policy.

4. Placing Orders and Conclusion of the Sales Contract

Orders may be placed through the Store using the ordering process available on Louveedc.com.

To place an order, the Customer selects the desired product, configures the available product options where applicable, adds the product to the cart, provides the information required for checkout, selects the available delivery and payment methods, and confirms the order.

Before submitting an order, the Customer is given the opportunity to review the order details and correct any errors.

By submitting the order, the Customer makes an offer to purchase the selected products under these Terms & Conditions.

The sales contract is concluded when the Seller confirms acceptance of the order by email or otherwise confirms that the order has been accepted for processing.

After placing an order, the Customer will receive an electronic confirmation containing information about the order.

The Customer is responsible for ensuring that all information and product configuration choices provided during the ordering process are correct.

For custom-made or individually configured products, the specifications selected by the Customer during the ordering process form part of the sales contract.

5. Prices and Payments

All product prices displayed in the Store are stated in the currency shown on the website and include applicable taxes unless otherwise indicated.

The total price payable by the Customer is shown before the order is submitted and includes the price of the products, applicable taxes and any delivery or other charges that apply to the order.

Available payment methods are displayed during checkout and may vary depending on the Customer’s location, order value or other relevant factors.

Payment may be processed by external payment service providers. The Customer may be required to accept the payment provider’s own terms and conditions in order to complete the payment.

The Seller is not responsible for delays or failures caused solely by the payment service provider, bank or other financial institution, provided that the Seller has properly performed its own obligations.

If payment is not completed successfully, the order may not be accepted or processed.

Where the Store allows payment within a specified period after placing an order, failure to make payment within that period may result in cancellation of the order.

6. Order Processing and Delivery

Orders are processed after the Seller has received successful payment or confirmation that payment has been authorised, unless another payment arrangement is expressly offered by the Store.

The estimated production or order processing time is indicated on the website, in the product information, during the ordering process or in the order confirmation.

Because many Louve EDC products may be custom-made or individually configured, processing times may vary depending on the selected product, configuration, current order volume and availability of materials or components.

Any processing or delivery time stated by the Store is an estimate unless expressly stated otherwise.

Once the order has been prepared for shipment, it will be handed over to the selected postal, courier or logistics provider.

The Customer may receive an email confirming that the order has been dispatched and, where available, shipment tracking information.

Delivery costs are calculated or displayed during checkout before the Customer submits the order.

The Customer is responsible for providing a complete and accurate delivery address. Additional costs resulting from an incorrect or incomplete address provided by the Customer may be charged to the Customer where permitted by applicable law.

If the Seller becomes unable to fulfil an order, for example because of unavailable materials, components or other circumstances preventing performance of the contract, the Customer will be informed without undue delay. Where payment has already been made, the appropriate amount will be refunded.

7. Order Cancellation

The Customer may request cancellation of an order by contacting the Store at louve.edc@gmail.com.

A cancellation request should be submitted as soon as possible.

If the order has not yet entered production, preparation or shipment, the Seller will make reasonable efforts to cancel the order and, where applicable, refund any payment already made.

Because many Louve EDC products are custom-made or individually configured, cancellation may no longer be possible once production or individual preparation of the product has started.

Cancellation of an order is separate from the statutory right of withdrawal from a distance contract. The Customer’s right of withdrawal, including any applicable exceptions for custom-made or personalised products, is described in Section 8 below.

8. Right of Withdrawal

Consumers generally have the right to withdraw from a distance contract within 14 days without giving any reason, unless an exception provided by applicable law applies.

The withdrawal period generally expires 14 days after the day on which the Customer, or a third party indicated by the Customer other than the carrier, takes physical possession of the goods.

To exercise the right of withdrawal, the Customer must inform the Seller of the decision to withdraw from the contract by means of a clear statement sent to:

ALAMO COMPANY SPÓŁKA Z OGRANICZONĄ ODPOWIEDZIALNOŚCIĄ
Czarnożyły 148
98-310 Czarnożyły
Poland
Email: louve.edc@gmail.com

The Customer may use a withdrawal form where one is provided, but use of such a form is not mandatory.

The Customer must return the goods without undue delay and no later than 14 days from the date on which the Seller was informed of the withdrawal.

Unless otherwise required by applicable law or expressly agreed by the Seller, the Customer bears the direct cost of returning the goods.

The Seller will reimburse all payments received from the Customer, including the cost of the least expensive standard delivery method offered by the Store, without undue delay and no later than 14 days from the date on which the Seller is informed of the Customer’s decision to withdraw from the contract.

The reimbursement will be made using the same payment method used by the Customer for the original transaction, unless the Customer expressly agrees to another method that does not result in any additional costs for the Customer.

The Seller may withhold reimbursement until the returned goods have been received or the Customer has provided evidence of having sent the goods back, whichever occurs first, where permitted by applicable law.

IMPORTANT — CUSTOM-MADE AND INDIVIDUALLY CONFIGURED PRODUCTS

The statutory right of withdrawal does not apply where the subject of the contract is a non-prefabricated product made according to the Customer’s specifications or intended to satisfy the Customer’s individual needs, where the conditions of the applicable legal exception are met.

This may apply in particular to Louve EDC holsters and other products manufactured or individually configured according to specifications selected by the Customer, including, where relevant, firearm model, carry position, holster model, draw hand, material, colour, mounting system, retention system, weapon light compatibility or other individual configuration options.

The exclusion of the right of withdrawal for custom-made or individually configured products does not affect the Customer’s statutory rights in relation to defective or non-conforming goods.

9. Returns

Where the Customer has a statutory right of withdrawal and exercises that right correctly, the returned product should be sent to the following return address:

ALAMO COMPANY SPÓŁKA Z OGRANICZONĄ ODPOWIEDZIALNOŚCIĄ
ul. Zielna 31
95-200 Pabianice
Poland

Returned products should be securely packaged in a manner appropriate for transport.

The Customer is responsible only for any diminished value of the goods resulting from handling beyond what is necessary to establish the nature, characteristics and functioning of the goods, in accordance with applicable consumer law.

Returns should not be sent using cash-on-delivery shipping unless this has been expressly agreed with the Seller.

This section applies only to products for which the Customer has a statutory right of withdrawal. It does not create a right to return custom-made or individually configured products where the statutory exclusion described in Section 8 applies.

10. Complaints and Product Conformity

The Seller is responsible for the conformity of products with the sales contract in accordance with applicable consumer law.

If a product is defective, damaged, incomplete or otherwise does not conform to the contract, the Customer may submit a complaint by contacting the Seller at:

louve.edc@gmail.com

The complaint should, where possible, include the order number, a description of the problem and the Customer’s requested remedy. Photographs or other information may also be provided where they may help assess the complaint.

A consumer may request repair or replacement of a non-conforming product in accordance with applicable law. Where the legal requirements are met, the consumer may also be entitled to a price reduction or termination of the contract.

The Seller will respond to a consumer complaint within 14 days from the date it is received. If the Seller does not respond within that period, the complaint will be treated in accordance with applicable law.

Where a product must be made available for repair or replacement, the Seller will bear the costs required by applicable law, including the costs of collecting or transporting the product where applicable.

If the Seller requests that the product be returned or made available for inspection, the Customer will be informed of the appropriate procedure.

The Seller’s statutory liability for lack of conformity of goods with the contract generally applies for two years from delivery of the goods, subject to applicable law.

Any manufacturer’s warranty or other voluntary guarantee is independent of the Customer’s statutory rights relating to the conformity of goods with the contract.

Nothing in this section limits the Customer’s mandatory statutory rights.

11. Custom-Made and Personalised Products

Many products offered by Louve EDC are made to order or individually configured according to specifications selected by the Customer.

Depending on the product, the Customer may be able to select options such as the firearm model, carry position, holster model, draw hand, material, colour, mounting system, retention system, weapon light compatibility and other available configuration options.

The Customer is responsible for carefully reviewing all selected options before submitting the order.

Products manufactured or prepared according to the Customer’s individual specifications may differ from example photographs shown on the website, particularly in relation to colour, finish, texture, proportions or the final appearance resulting from the selected configuration.

Product images, visualisations and preview images are provided for illustrative purposes unless expressly stated otherwise. The final product will be manufactured according to the configuration selected by the Customer.

Once production of a custom-made or individually configured product has started, changes to the selected configuration may not be possible.

Custom-made or individually configured products may also be excluded from the statutory right of withdrawal where the conditions described in Section 8 apply.

This does not affect the Customer’s statutory rights where the delivered product is defective or does not conform to the agreed specification.

12. Intellectual Property

All content available on Louveedc.com, including texts, product descriptions, photographs, graphics, logos, designs, visual elements, website layout and other materials, may be protected by copyright, trademark rights or other intellectual property rights.

Unless expressly permitted by the Seller or by applicable law, the Customer may not copy, reproduce, modify, distribute, publish, commercially exploit or otherwise use content from the Store beyond what is necessary for normal personal use of the website.

The name Louve EDC, its logos and other brand identifiers may not be used in a manner that could suggest affiliation, sponsorship or endorsement without the Seller’s prior permission.

Nothing in these Terms & Conditions transfers any intellectual property rights to the Customer.

13. Personal Data

Personal data provided by Customers in connection with the use of the Store, creation of a customer account, placement and fulfilment of orders, payments, delivery, complaints, returns or contact with the Seller is processed in accordance with applicable data protection laws.

Detailed information about the processing of personal data, the purposes and legal bases of processing, data retention, recipients of personal data, international transfers and the Customer’s rights is provided in the Privacy Policy available on Louveedc.com.

Where the Store uses cookies or similar technologies, information about their use and the available choices is also provided in the Privacy Policy and, where applicable, through the website’s cookie consent mechanism.

14. Complaints and Out-of-Court Dispute Resolution

A Customer who is a consumer may use available out-of-court complaint and dispute resolution procedures in accordance with applicable law.

Information about available consumer dispute resolution bodies and procedures may be obtained from the relevant consumer protection authorities, including the Polish Office of Competition and Consumer Protection (UOKiK), local consumer ombudsmen and the Trade Inspection authorities.

Use of an out-of-court dispute resolution procedure is voluntary unless applicable law provides otherwise.

Nothing in this section limits the Customer’s right to bring a claim before a competent court.

15. Final Provisions

These Terms & Conditions are governed by Polish law, without depriving consumers of any mandatory protections granted to them under the laws applicable in their country of residence.

If any provision of these Terms & Conditions is found to be invalid or unenforceable, the remaining provisions will remain in effect to the extent permitted by law.

The Seller may amend these Terms & Conditions where reasonably necessary, including due to changes in applicable law, the operation of the Store, available services or technical requirements.

Changes to these Terms & Conditions will not adversely affect orders or contracts concluded before the amended version became effective, unless required by applicable law.

The version of the Terms & Conditions applicable to an order is the version in force at the time the Customer submits that order.

Any disputes arising from contracts concluded through the Store will be resolved by the competent courts in accordance with applicable law.

These Terms & Conditions are effective from the date stated below.
